RULES FOR SELLING ONLINE

TERMS USED IN THE RULES

1.1. the Private Limited Liability Company "Lumina Park LT", company code 305610003, Vilnius, Eišiškių Sodų 18-oji g. 11, NTR object code: 4400-1839-513.

1.2 The controller of the personal data is LUMINA Sp. z o.o., whose registered office is Bielany Wrocławskie, 55-040 Kobierzyce, ul. Błękitna 3, e-mail address: ado@luminapark.pl.

1.3. LUMINA Sp. z.o.o. is the founder and shareholder of Lumina Park LT UAB, a company operating in Lithuania.

1.4. Lumina Park LT UAB (hereinafter referred to as "LUMINA"), company code: 305610003, VAT payer code LT100013604318, company registration address: Eiškių Sodų 18-oji g. 11, LT-02194 Vilnius.

1.5. "Rules" - the rules of Lumina's online ticket sales.

1.6. "System" means iKSORIS, the online ticketing system.

  1. "Website" means the website https://bilietai.luminapark.lt/ used to sell tickets through the System.
  2. "Customer" means any purchaser, natural person (consumer), business entity and other organisation using the System.
  3. "Event" means a Lumina exhibition or a group of exhibitions for which common ticket types apply, or individual events organised by Lumina for which Lumina decides to sell tickets online.
  4. "Ticket" means an admission ticket which entitles the holder to attend certain Lumina exhibitions or attend an event organised by Lumina.
  5. "Payment Website" means Lumina Park LT, UAB, company code 305610003, address: 11 Eišiškių Sodų 18-oji str., Vilnius. 4400-1839-513, administered by the website where the online payment service is provided by the company PayU, address: 60-166 POZNAŃ WIELKOPOLSKIE, VAT payer code: 7792308495, company code: 300523444, JAR code: 0000274399. Authorised capital 6.474.300. PLN 6 47,474,477,476, no debts identified.




  1. GENERAL PROVISIONS

2.1 These Terms and Conditions set out the procedure for the online sale of Lumina Tickets using the Online Sales System. 

2.2 In order to use the System, it is necessary to become familiar with the Terms and Conditions and to accept their terms. Acceptance of the Terms and Conditions constitutes a declaration of intent and creates legal obligations for the Customer and Lumina.

2.3 The Buyer shall use the System in accordance with the procedures set out in the Terms and Conditions and in compliance with applicable law.

2.4 Technical requirements necessary to ensure the technical operation of the System:

2.4.1. a computer or other mobile device with a web browser and internet access,

2.4.2. an email account,

2.4.3. a bank account with internet access.

 

  1. PLACING AN ORDER

3.1 An Order shall be placed on the pages of the System by doing the following:

3.1.1. selecting the Event, Ticket type and quantity,

3.1.2. correctly filling in the required fields of the Order Form or creating a User Account,

3.1.3. checking that the order details and details entered are correct,

3.1.4. confirming acceptance of the Terms and Conditions,

3.1.5. place the order by clicking BUY AND PAY,

3.1.6. proceed to the Payment page.

3.2 After placing the order, the Buyer receives a notification of the order creation at the e-mail address indicated.

3.3 Lumina reserves the right to limit the number of tickets available for organised events.

 

  1. PAYMENT AND EXECUTION OF THE ORDER

4.1 The Buyer must pay for the Order within 30 (thirty) minutes of its creation. An order not paid in time shall be automatically removed. Once the order has been cancelled, the Buyer's e-mail address

e-mail address of the Buyer, a cancellation notice is automatically sent.

4.2 The Buyer shall pay for the created order on the Payment Website.

4.3 Payment for a single order must be made in one payment. 

4.4 Lumina shall not be liable for any consequences related to the malfunctioning of the bank indicated by the Customer when making the payment.

4.5 Lumina shall issue invoices at the Buyer's request, provided that the Buyer has indicated this in the "I wish to receive a VAT invoice" section of the order and has provided all the necessary and correct details for the invoice. Invoices shall be issued upon payment.

4.6 By ticking "I wish to receive a VAT invoice", the Buyer agrees to receive an electronic invoice at the e-mail address indicated. Consent does not waive Lumina's right to issue and send paper invoices.

4.7 Lumina shall not be liable for the consequences if the Buyer provides false

or incorrect data necessary for the issue of the VAT invoice.

4.8 The order shall be executed upon receipt of payment confirmation from the TPay system.

4.9 The acceptance of payment and the execution of the order shall be notified automatically by an e-mail generated by the System to the address indicated by the Buyer

an e-mail containing the purchased Tickets saved in a PDF file.

4.10. The cost of the connection to download the e-mail shall be borne by the Buyer in accordance with the tariffs set by his/her operator.

4.11. Lumina shall not be liable for the consequences of the Buyer's disclosure of order details to third parties. If the Buyer provides the Ticket to a third party, there is a risk that the Ticket may be used by this person. "Lumina shall recognise the Ticket of the person who first presents it in such case.

4.12. Lumina is not responsible for messages deleted or unread by the Customer.

 

  1. TICKETS

5.1 Ticket prices are set out in the Lumina price list. "Lumina publishes ticket prices on its website https://bilietai.luminapark.lt/

5.2 Ticket prices are quoted in euros including VAT

5.3. The system shall allow the purchase of selected tickets from Lumina's price list.

5.4 The fact that tickets are not available for purchase through the System does not imply that tickets are not "Tickets are not available at the Lumina box offices.

5.5 The expiry date of a Ticket shall be indicated on the Ticket.

5.6 The expiry date of Tickets purchased at the Ticket Office may differ from the expiry date of Tickets purchased through the System.

5.7 The ticket shall be redeemed upon presentation to a Lumina employee at the entrance to the event.

5.8 Persons who have purchased concessionary tickets must present on the day of their visit, together with the ticket.

"Lumina staff with the documents entitling them to the concession.

5.9 Concessionary tickets without entitlement documents will not be accepted or refunded.

5.10. Concessionary tickets shall be issued in accordance with Lumina's current price list.

 

  1. PERSONAL DATA AND PRIVACY POLICY

  4. We collect your personal data in order to provide a service,

as provided for in the Terms and Conditions. 

  1. The recipients of personal data are:

- Subjects entitled to receive the data in accordance with the legislation, persons authorised by the controller,

- Entities entrusted by the controller with the performance of acts which require the processing of data.

  1. Your personal data are not provided to third countries/international organisations.
  2. We process personal data for a period of 5 years from the beginning of the year following the year in which the order was placed, as well as for the period necessary to comply with the statutory archiving obligation.
  3. Remember you have the right to:

- access, rectification, erasure, restriction of processing, portability and objection to your personal data. In these cases, please contact the Personal Data Controllers directly (info@luminapark.lt).

- lodge a complaint with the supervisory authority responsible for the protection of personal data, i.e. the Inspectorate for the Protection of Personal Data, if you consider that the processing of your personal data infringes the provisions of the GDPR.

  1. Personal data is not processed by automated means and is not subject to profiling.
  2. Personal data is stored and processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("GDPR"), and the Regulation (EU) 2016/679 of the European Parliament and of the Council of 18 May 2018. Personal Data Protection Act (OJ, 2019, No. 1781).
  3. Information on the processing of personal data shall be sent to the Buyer with the automatic notifications sent by the System to the e-mail address indicated when filling in the Order Form or creating a User Account.
  4. "Lumina“ shall not be liable if false or incorrect data is provided in the Order Form.
  5. COMPLAINTS

 

7.1 Any queries, comments or complaints relating to the purchase and use of Tickets must

should be sent to info@luminapark.lt.

7.2 A complaint may be lodged no later than 14 days after the event giving rise to the complaint. In the complaint, the Buyer must specify:

7.2.1. the order number of the order which is the subject of the complaint,

7.2.2. the reason for the complaint and a description of the matter complained of,

7.2.3. the name of the complainant,

7.2.4. e-mail address,

7.2.5. telephone number.

7.3 Complaints shall be dealt with by Lumina within 14 days from the date of receipt, unless the cause of the complaint relates to the payment operator PayU. In this case, the complaint shall be forwarded to the payment operator PayU for processing (the duration of the processing may

longer). The decision shall be notified to the Buyer by a reply e-mail.

7.4 If the complaint is resolved in favour of the Customer, the Customer shall receive a refund. The refund shall be made by transfer to the account specified by the Customer.

7.5 Lumina shall not be liable for any improperly submitted complaint, in particular for incorrect or false data provided by the Customer.

 

  1. RETURNS

8.1 Tickets purchased online for exhibitions and other cultural events are non-refundable and non-exchangeable for other tickets or tickets valid for another event (10 November 1994. No. I-657 Law on the Protection of Consumer Rights of Lithuania). By purchasing a Ticket, the Purchaser declares that he/she has been informed that he/she has no right to cancel the Ticket purchased and to claim a refund of the value of the Tickets purchased.

 

  1. OTHER PROVISIONS

9.1 Lumina shall not be liable for any interruptions in data transmission

when purchasing tickets, interruptions in the operation of the System and errors caused by any reason beyond Lumina's control.

9.2 Lumina shall not be liable for messages or data lost or misplaced on the Internet due to reasons beyond Lumina's control.

9.3 Before visiting Lumina, it is necessary to check whether Lumina accepts visitors on the chosen day and what the conditions of the visit are (opening hours, etc.). "Lumina publishes information on opening hours and parks that are temporarily closed on its website https://bilietai.luminapark.lt/ or www.luminapark.lt.

9.4 Lumina reserves the right to decide freely when to commence and terminate the online sale of Tickets for each Event.

9.5 Lumina reserves the right to suspend online sales at any time for accidental or technical reasons, including in the event of a pandemic. Ticket sales may be subject to other restrictions as provided for by applicable law.

9.6 Lumina reserves the right to change the Terms and Conditions.

9.7 In cases not covered by the Rules, the provisions of law shall apply, in particular those of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("the GDPR"), and the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 18 May 2018.
